The Presiding High Court judge, Justice Afia Serwah Asare-Botwe has strongly advised Attorney-General Godfred Yeboah Dame to stay way from the ongoing ambulance case involving Hon. Ato Forson and Mr. Jakpa.
The directive follows allegations of professional and prosecutorial misconduct against the Attorney-General.
This unprecedented ruling marks the first time in Ghana’s legal history that a court has instructed an Attorney-General to withdraw from a trial.
The judge’s decision came after the court declined to order an enquiry and mistrial based on the alleged prosecutorial misconduct.
The court has further advised Hon. Ato Forson to seek redress at the General Legal Council if he wishes to pursue the matter further. In a significant development, the court has admitted a telephone recording between Mr. Jakpa and the Attorney-General into evidence, despite objections from the Attorney-General regarding its admissibility.
