In a significant development today, the High Court has admitted a controversial leaked audio recording of discussions between the Attorney General, Godfred Yeboah Dame and Richard Japka into evidence.
The decision came after intense debate over the admissibility of the controversial recording, which has sparked widespread public and media interest.
The audio, which was released by the NDC during a press conference last month, captures conversations between the Attorney General and Richard Japka discussing sensitive legal matters in relation to the ongoing ambulance trial involving Minority Leader, Hon. Dr. Cassiel Ato Forson.
On Tuesday , 11th June 2024, the 16-minute audio recording was played in open court. After it was played, the Director of Public Prosecution (DPP) Yvonne Atakora Obuobisa, opposed the request for the same to be tendered into evidence.
The DPP argued that an insufficient foundation has been laid by lawyers for the first accused person to warrant the recording’s inclusion into evidence in the ongoing criminal trial of Cassiel Ato Forson, Sylvester Anemana (Discharged) and Richard Jakpa.
However, today, the high court presided over by Court of Appeal judge, Justice Afia Serwaa Asare Botwe ruled that the audio would be considered valid evidence, emphasizing that it goes to the root of the motives behind the prosecution’s case, as averred by A1[Ato Forson] in his application for a mistrial.
The trial judge insisted that she will attach the needed weight to the evidence and further admitted it when delivering final judgement on the admissibility of the leaked audios.
The Attorney General’s office, alongside Japka, has been under the spotlight since the audio was released.
Critics and supporters alike have debated the legality and ethical implications of the audio’s content and its potential impact on the justice system.
The decision of the High Court to admit the leaked audio into evidence marks a pivotal moment in the case, with many believing that it may potentially influence the outcome.
The Attorney General’s office is yet to make an official statement regarding the High Court’s decision as at the time of filing this report.
