The Supreme Court has dismissed an application for an interim injunction seeking to stop the Amenfi Central Parliamentary election from proceeding as planned.
The application, filed by plaintiffs in an ongoing case at the Sekondi High Court, was heard by Justice Yonni Kulendi, the sole judge assigned to the matter, during an ex parte session on Thursday, December 5.
Justice Kulendi’s decision clears the way for the election to continue as scheduled, dealing a significant blow to the plaintiffs’ efforts to halt the process.
The plaintiffs had filed a certiorari application on Wednesday, December 4, aiming to overturn a ruling by the Sekondi High Court that vacated an earlier injunction against the National Democratic Congress (NDC) and the Electoral Commission (EC). The injunction had initially barred Joana Gyan Cudjoe, the NDC’s candidate for Amenfi Central, from contesting the parliamentary election.
The High Court’s November 11 decision to lift the injunction was delivered by His Lordship George K. Gyan-Kontoh. The ruling followed a formal request from the NDC to dismiss the disqualification case against their candidate.
Edudzie Tamakloe, a lead counsel for Joana Gyan Cudjoe, had previously sought and obtained an adjournment of the hearing to allow time to address the plaintiffs’ arguments.
The plaintiffs’ latest move to the Supreme Court was seen as a last-ditch effort to prevent the election from going ahead. However, Justice Kulendi’s dismissal of their application underscores the court’s position, ensuring that Joana Gyan Cudjoe remains eligible to contest the election under the NDC’s banner.
With this ruling, all legal barriers to the Amenfi Central election have been removed, and the Electoral Commission is set to proceed with the electoral process as planned.
